File a Memorandum of Contract in Texas
Under contract on a Texas property and want to make sure the seller can't quietly sell to someone else? Recording a memorandum of contract puts the public on constructive notice of your equitable interest. You sign with the online notary; we record it with the county and send you the recorded copy.
How it works in Texas
A memorandum is a short instrument recorded in the county real-property records. It references the parties and the property and gives notice that a purchase contract exists — without disclosing the price or terms. Once recorded, a title search turns it up as an exception, which practically stops a clean sale to anyone else while your contract is live. It is lawful notice of a genuine, executed contract — not a lien and not a pressure tactic.
Texas has a specific statute for this. Under Property Code §12.020, a residential memorandum must be accompanied by a certified-mail notice to the owner and a recorded sworn certificate of mailing, with a 45-day owner release-by-affidavit window. Jurably automates the §12.020 process — see the Texas §12.020 guide.
